If your Labour Dispute is Province-Wide or National,
we can arrange for Investigators right across the Country
through our National Network of Labour Dispute Investigators
with whom we have contracts with and with various other
Agencies across the Country.
iv. KNOWING THE LAW
We are very well versed in the areas of Labour Law that deals with Labour Disputes, including the Labour Relations Act of Ontario as well as Section 102 of the Ontario Courts of Justice Act, and the various other labour statutes in the other 9 Provinces, which outlines the prerequisites for obtaining Injunctive Relief from the Courts.
v. YOU MAY NEED INJUNCTIVE
RELIEF
In order to be successful in an Application for an Injunction, the Courts have required expert testimony and video evidence from Private Investigators that:
- There is harm to the company’s business activity if
the Injunction isn’t obtained
- That the Picketing is so disruptive to the point where
there is a potential for a vehicular traffic accident
or evidence of violence
- That the Picketers are holding up pedestrians and/or
vehicles for longer than the Courts have deemed reasonable,
i.e. 5-10 minutes per vehicle or pedestrian
- That the Union has refused to enter into a Picketing
Protocol Agreement and/or is violating the terms of the
Picketing Protocol Agreement
- That the local Police have been called and have refused
to intervene or assist, which is usually the case in
99% of the time, as they regard such incidents as a civil
matter and not a criminal matter.
You need and want a team that know what evidence is required by the Court and who have the experience and the know how to accurately and effectively gather it and present it in Court.
vi. ENFORCEMENT OF COURT
ORDERS
Once the Injunction is obtained, the Order of the Court is then served on the Union and to all the Picket Captains at the Picket Lines are served with the Order and if there is a violation of the Order, the Private Investigators will be present to record by Video Surveillance the infractions.
